Fractional Ownership Liability
Owning an aircraft can be an expensive proposition as the high acquisition cost is just the beginning. The operational costs and resource allocation for setting up your own flight department can be a daunting task. Buying a fractional share of an aircraft whereby you leave the management and operation to professional aviators can be a good alternative. Although the Fractional Aircraft Program provides Hull and Liability insurance for all owners, please keep in mind that this limit is split amongst all owners in the Program. This may or may not be enough to cover your interest should the unthinkable ever occur.

Non-Owned Unmanned Aerial Vehicle Use
The use of drones in our everyday life has brought about the need to protect your liability interests should you venture into hiring an operator to perform operations on your behalf. This could be as simple as filming an advertisement, surveying a building site/land to the more complex operations such as using a UAV to protect your valuable crops through agricultural applications. Most UAV operators carry liability coverage, however, that coverage is typically limited to $1,000,000 or less. This limit would be extended to protect your interests if you were named as an Additional Insured under their policy and would be shared between all parties involved. Having your own protection, which you control, would ensure your interests are protected. Typical coverage would include but is not limited to the following:

Examples of who may need Non-Owned Aircraft Liability Protection

Individuals or corporations that do not own an aircraft and either charters, leases or uses an aircraft for personal or business transportation.

Aircraft owners that use a management service and place coverage under that managers fleet policy, their Non-Owned coverage grant may not extend to you or your company should you need to use supplemental travel outside of that group policy.

Individuals, corporations and organizations that have purchased a fractional share of an aircraft for the purposes of transportation and in which that aircraft is managed by a professional manager and crewed by professional pilots.

A corporation that has an employee pilot who owns, rents, leases or operates an aircraft on company sponsored business.

A Professional pilot who is an independent contractor and who operates other’s aircraft.
Is there coverage/protection under the owner’s/operator’s policy for charter customers or other users and is it appropriate to cover your interests?
It truly depends on the owner’s/operator’s policy and several factors that should be considered for which your insurance broker/professional can be consulted. Coverage may extend to you and your organization as most policies extend coverage for bodily injury and property damage (Liability Coverage) to permissive users, however; this does not apply with respects to physical damage to the aircraft. Below are some factors to consider when determining if coverage is appropriate:
- Does the policy have adequate limits? – keep in mind that the policy limits will be shared amongst all users/passengers including the operator/owner.
- Is the owner/operator abiding by the insurance contract language, i.e. use clause, pilot warranty etc.?
- Are you named as an additional insured, provided a waiver of subrogation (WOS) and does it have Primary and non-contributory wording?
- If you are in the “aviation” business i.e., you are responsible for arranging the flight, providing professional piloting service etc., coverage may not extend to your interest if not specifically mentioned or endorsed to do so
Can I purchase coverage for myself and or my organization to protect my interests if I use aircraft that I do not own or if I own a fractional share of an aircraft?

Policies can be broad in scope and can include a wide array of aircraft provided they are only operated by professional pilots furnished by the aircraft owner such as a chartered aircraft. The policy would primarily provide contingent liabilities since the charter customer is not directly involved with the operation of the aircraft. If the pilot is an employee of your organization, coverage may still be available, but would be rated in accordance with the pilot’s experience and may be limited to certain aircraft types or models.
